Condiciones Generales de Uso del servicio Lead Retrieval
1. Condiciones generales de uso y aceptación de las mismas
Las presentes Condiciones Generales de Uso regulan expresamente la relación surgida entre FIRA DE BARCELONA y los usuarios (expositores) que adquieran el servicio de gestión de contactos Lead Retrieval ofrecido por FIRA DE BARCELONA.
La utilización de este servicio supone la plena aceptación, como usuario y sin reservas de ningún tipo, de las Condiciones Generales de Uso descritas en el presente documento.
Si está utilizando nuestros servicios en nombre y representación de cualquier entidad, declara y garantiza que está autorizado para aceptar estos términos y condiciones en nombre de dicha entidad, y que dicha entidad acuerda indemnizarle a usted y a nosotros en caso de cualquier infracción de los presentes términos y condiciones.
FIRA DE BARCELONA podrá, en todo momento, modificar las presentes Condiciones Generales de Uso mediante la publicación en línea de las modificaciones efectuadas, a fin de que sean conocidas con carácter previo por los usuarios. Puede consultar estas condiciones de uso en www.firabarcelona.com.
2. Servicio Lead Retrieval
El servicio Lead Retrieval proporcionado por FIRA DE BARCELONA permite a los usuarios capturar y gestionar la información de los asistentes a un evento que contienen los diferentes pases personales, y que consiste en la información proporcionada en el proceso de registro de ese evento. Las siguientes condiciones se aplican a todos los usuarios y todos los aspectos del servicio, incluidos, sin limitación, el portal web y el escáner móvil.
Todos los dispositivos serán smartphones con Android 5.0 o superior y con una pantalla de 5″ o mayor, con un plan de datos 4G proporcionado por un operador. Las unidades son limitadas y están sujetas a disponibilidad. La licencia de escaneado permite el acceso y la utilización de la aplicación Lead Retrieval de Fira de Barcelona. El usuario reconoce que se le ha informado y que se le ha facilitado toda la información necesaria para una correcta utilización de la aplicación.
Esta información se obtendrá con la app oficial de Lead Retrieval de Fira de Barcelona mediante el proceso de escaneado y se podrá acceder a ella en los dispositivos móviles con la aplicación instalada y en el servicio web de back office.
El proceso antes mencionado es un intercambio de información voluntario con el que ambas partes, la que escanea (con la app Lead Retrieval de Fira de Barcelona) y la escaneada (la persona inscrita en el evento), están de acuerdo.
3. Acceso al servicio de gestión de contactos Lead Retrieval
El usuario puede acceder al servicio de gestión de contactos en calidad de expositor o de visitante a un evento organizado por Fira de Barcelona. Si el usuario accede al servicio en calidad de expositor, deberá proporcionar su nombre de usuario y contraseña. El nombre de usuario y contraseña facilitados son los elementos identificadores que permiten al usuario acceder a este servicio y tienen carácter personal e intransferible.
4. Uso de Lead Retrieval para la vigilancia y control del Covid SARS-coV-2
Excepcionalmente será obligatorio el uso de Lead Retrieval y el tratamiento de los datos obtenidos a través de este como modo de vigilancia y control del Covid SARS- coV-2, de manera que los expositores estarán obligados a recoger los datos de aquellos contactos con los que hayan mantenido reuniones, entrevistas de más de 15 minutos y cualesquiera otras actividades que puedan considerarse de riesgo.
Solo en los casos en los que así lo prevea la normativa vigente en cada momento, Fira de Barcelona está obligada a proporcionar a las autoridades sanitarias información relativa a los contactos que pudieran potencialmente ser positivos. Los datos que se proporcionarán, en caso de ser requeridos, consistirán únicamente en: datos identificativos consistentes en nombre, apellidos y mail.
5. Obligaciones del usuario
El usuario se obliga a usar el servicio de gestión de contactos Lead Retrieval de forma diligente, correcta y lícita, y se compromete a abstenerse de:
a) Utilizarlo con propósitos o fines contrarios a la ley, a la moral y a las buenas costumbres o al orden público.
b) El usuario se obliga a proporcionar información correcta y completa cuando se registre en el servicio y cuando lo utilice, y a actualizar sus datos para garantizar que la información sea correcta y esté completa en todo momento.
c) El usuario se compromete a utilizar los datos personales de conformidad con las leyes de su país y respetando la legislación de la UE. En todo caso será necesaria la autorización previa del asistente para la utilización de sus datos.
El incumplimiento por parte del usuario de sus obligaciones respecto a la utilización del servicio dará derecho a FIRA DE BARCELONA, a su discrecionalidad y sin previo aviso, a bloquear el acceso del usuario al servicio de gestión de contactos Lead Retrieval si considera que se han incumplido las Condiciones de Uso. El incumplimiento de estas Condiciones de Uso constituye una práctica empresarial ilícita y desleal, que puede provocar un perjuicio a FIRA DE BARCELONA y/o al resto de usuarios del servicio, por lo que el usuario asume y se responsabiliza de las consecuencias que de dichos perjuicios puedan derivarse, con entera indemnidad de FIRA DE BARCELONA como organizador del evento.
6. Responsabilidad de FIRA DE BARCELONA
El usuario reconoce y acepta que la utilización del servicio se realiza bajo su entera responsabilidad, con total indemnidad de FIRA DE BARCELONA.
FIRA DE BARCELONA únicamente responderá por los daños que el usuario pueda sufrir como resultado de la utilización del servicio cuando dichos daños sean imputables a una actuación dolosa de FIRA DE BARCELONA.
No obstante, por la presente FIRA DE BARCELONA declara haber adoptado todas las medidas necesarias, dentro de sus posibilidades y del estado actual de la tecnología, para garantizar el correcto funcionamiento del servicio.
En cualquier momento, FIRA DE BARCELONA se reserva el derecho a: (1) modificar o suspender el acceso a parte o a la totalidad del servicio por motivos debidamente justificados; (2) modificar parte o la totalidad de cualquier política o condición aplicable al servicio; y (3) interrumpir el funcionamiento de parte o de la totalidad del servicio, cuando sea necesario llevar a cabo tareas de mantenimiento, corrección de errores u otros cambios.
FIRA DE BARCELONA no garantiza en ningún caso que el servicio Lead Retrieval no contenga errores, ni que vaya a aportarle al usuario unos resultados específicos, ni de carácter económico ni de cualquier otro tipo.
FIRA DE BARCELONA no será en ningún caso responsable de daños indirectos, accidentales ni fortuitos, incluido el lucro cesante, aunque haya tenido conocimiento de la posibilidad de que tales daños pudieran producirse.
FIRA DE BARCELONA no garantiza la conectividad necesaria para la sincronización de información y el uso de los productos, servicios o dispositivos. Lead Retrieval de Fira de Barcelona no se hace responsable de las consecuencias de la falta de conectividad.
En caso de sufrir cualquier fallo, daño o pérdida del dispositivo, o cualquier problema con los servicios o productos, Lead Retrieval de Fira de Barcelona le sugiere que lo notifique al Servicio de Atención al Cliente de Lead Retrieval de Fira de Barcelona o a uno de sus representantes sin demora.
FIRA DE BARCELONA no será responsable de los actos imprevistos que lleven a cancelar o posponer el evento, tales como, a modo indicativo, pero no limitativo: manifestaciones o protestas, huelgas de cualquier tipo, daños estructurales, pérdida o escasez de suministro eléctrico o casos de fuerza mayor. Si tuviese lugar algún suceso imprevisto, las obligaciones de FIRA DE BARCELONA se darán por rescindidas y esta tendrá derecho a todos los pagos percibidos.
7. Descargo de responsabilidad
A menos que se establezca expresamente por escrito, nuestro sitio web, los materiales del sitio web, el contenido de terceros, el contenido del usuario, los hipervínculos, nuestros servicios y cualesquiera otros servicios o contenidos incluidos en nuestro sitio web o disponibles a través del mismo (colectivamente denominados «contenido o servicios de FIRA DE BARCELONA») se le proporcionan tal cual o según la disponibilidad sin ninguna declaración, garantía ni condición de ningún tipo. No garantizamos que el contenido o servicios de FIRA DE BARCELONA estén libres de virus u otros componentes dañinos. No declaramos ni garantizamos la disponibilidad, la fiabilidad o la seguridad de cualquier contenido o servicio de FIRA DE BARCELONA. A menos que se establezca expresamente por escrito, renunciamos a todas las garantías y declaraciones (explícitas o implícitas, verbales o escritas) con respecto a todo el contenido o servicios de FIRA DE BARCELONA, ya surjan supuestamente de la aplicación de la ley, en razón de la costumbre o el uso comercial, en el curso de una negociación o de otra manera, incluidas: (i) cualquier garantía de comerciabilidad; (ii) todas las garantías de aptitud o idoneidad para cualquier propósito (lo supiésemos o no, tuviésemos motivos para saberlo, se hubiese aconsejado saberlo o fuésemos conscientes de tal propósito de otro modo), y (iii) todas las garantías de título o de inexistencia de infracción.
8. Anulaciones
El usuario podrá darse de baja del servicio de gestión de contactos Lead Retrieval en cualquier momento, sin derecho a devolución de los importes satisfechos hasta esa fecha, ni a reclamación de clase alguna. Puede ponerse en contacto con el equipo de Lead Retrieval en [email protected].
9. Protección de datos personales
Se le informa que al recabar información y datos personales (en adelante «Datos Personales») a través de estos Dispositivos, se convertirá en procesador de datos y responsable del tratamiento de los mismos en virtud del Reglamento General de Protección de Datos 679/2016 de 26 de Abril. Por consiguiente, usted puede estar obligado a:
a) Informar a todos los visitantes cuyos datos personales recabe de que dicha obtención se lleva a cabo, de acuerdo con lo dispuesto en el art. 13 del referido Reglamento.
b) Garantizar el ejercicio de los derechos de acceso, rectificación, limitación del tratamiento, portabilidad de los datos y oposición, así como el derecho a no ser objeto de decisiones individuales automatizadas incluida la elaboración de perfiles.
c) Velar por que se adopten las medidas técnicas y organizativas apropiadas para garantizar y poder demostrar que el tratamiento es conforme con el referido Reglamento.
d) No distribuir a terceros, sin el consentimiento previo por escrito de los visitantes, los datos personales han sido recabados.
e) En general, deberá cumplir con todas las normas y reglamentos vigentes que le sean aplicables sobre la recopilación, el almacenamiento y el procesamiento de datos personales.
f) Para evitar cualquier duda, ni FIRA DE BARCELONA ni sus empresas subsidiarias serán responsables de cualquier incumplimiento de las leyes, normas o regulaciones (incluidas pero no limitadas al Reglamento General de Protección de Datos 679/2016 de 27 de Abril, a la Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico y la LOPDGDD 3/2018 de 5 de diciembre) en la recogida y tratamiento de Datos Personales. Usted acepta defender, indemnizar y mantener indemne a FIRA DE BARCELONA y a sus empresas subsidiarias, y a sus directores, gerentes, empleados, agentes y contratistas, frente a cualquier demanda por dicho incumplimiento.
10. Legislación aplicable
Las relaciones establecidas entre el usuario y FIRA DE BARCELONA se regirán por lo dispuesto en la normativa española vigente acerca de la legislación aplicable y la jurisdicción competente. No obstante, para los casos en los que la normativa prevea la posibilidad a las partes de someterse a un fuero, FIRA DE BARCELONA y el usuario, con renuncia expresa a cualquier otro fuero que pudiera corresponderles, acuerdan someterse a los juzgados y tribunales de la ciudad de Barcelona.
En todo caso serán aplicables las normas del ordenamiento jurídico español.
Productos y Servicios
1. Pedidos y plazos
a) Todos los pedidos realizados antes de la celebración del evento deberán abonarse íntegramente al menos 7 días hábiles antes de la fecha del evento.
b) Los pedidos realizados una vez iniciado el evento deben abonarse íntegramente en el momento del pedido.
c) Todos los pedidos realizados una vez iniciado el evento están sujetos a disponibilidad.
2. Condiciones de pago y cancelaciones
a) Se cancelarán los pedidos con saldos pendientes 7 días hábiles antes del comienzo del evento. Los pedidos podrán ser procesados de nuevo con un cargo de 50 € si el pago se recibiese dentro de los 7 días previos al inicio del evento. En tales casos, la configuración o la entrega del dispositivo podrían retrasarse.
b) Los pedidos cancelados están sujetos a la fijación de precios in situ si el nuevo pedido se gestiona en el evento. En estos casos, la configuración y la entrega del pedido podrían retrasarse y estará sujeto a disponibilidad.
c) Si el pago recibido difiere de los precios publicados en el momento de la compra, Lead Retrieval de Fira de Barcelona ajustará el importe del pago al precio que figura en la orden de pedido.
d) Todas las revisiones de pedidos realizadas después de la fecha límite antes del evento están sujetas a un cargo de 50 €.
e) No se realizarán reembolsos después de la fecha límite previa al evento.
f) Todos los dispositivos, servicios o productos no utilizados o que no se hayan recogido no son reembolsables.
g) Si detecta un fallo en su producto, dispositivo o servicio, traslade de inmediato su problema al Servicio de Atención al Cliente de Lead Retrieval de Fira de Barcelona. Si no lo hace en el momento oportuno no tendrá derecho al reembolso ni al reemplazo de los dispositivos.
3. Servicios in situ y condiciones
a) Los pedidos de los dispositivos, productos o servicios realizados in situ pueden necesitar hasta dos horas de procesado y están sujetos a disponibilidad. Lead Retrieval de Fira de Barcelona anima a los clientes a que realicen los pedidos con un margen considerable antes de que comience el evento.
b) Cualquier tipo de modificación o personalización de los productos, dispositivos o servicios de Lead Retrieval de Fira de Barcelona están sujetos a su disponibilidad técnica y pueden conllevar gastos de tramitación.
c) Los clientes de Lead Retrieval de Fira de Barcelona acuerdan cumplir todas las condiciones de uso de la gestión de eventos y de Lead Retrieval de Fira de Barcelona. El incumplimiento de estas condiciones por parte de cualquier cliente o parte no puede imputarse a Lead Retrieval de Fira de Barcelona. El cliente se compromete a mantener indemne a Lead Retrieval de Fira de Barcelona y esta se reserva el derecho a rescindir los servicios contratados, sin derecho a reembolso o indemnización alguna para las partes involucradas.
Además, Lead Retrieval de Fira de Barcelona tiene derecho a no entregar ningún tipo de información (clientes potenciales, encuestas, etc.) en caso de tal incumplimiento.
4. Escáner móvil
a) El usuario reconoce que se le ha informado y que se le ha facilitado toda la información necesaria para una correcta utilización de la aplicación y del escáner móvil.
b) El alquiler del escáner móvil incluye un dispositivo móvil para escanear los pases, la aplicación Lead Retrieval de Fira de Barcelona y una licencia de escaneado. Todos los dispositivos se entregan preconfigurados y listos para su uso.
c) El alquiler del escáner móvil también incluye conectividad 4G de acceso a internet durante la duración del evento, exclusivamente para el uso de Lead Retrieval de Fira de Barcelona.
d) FIRA DE BARCELONA no será en ningún caso responsable del servicio prestado por el operador ni del funcionamiento incorrecto de este, ni puede garantizar la disponibilidad de la conectividad 4G.
e) Todos los dispositivos se entregarán con un cargador y un cable USB o con un cargador de una pieza. Será responsabilidad del cliente comprobar que se incluyan todos los complementos y comunicar la falta de cualquiera de los complementos anteriormente citados al equipo del servicio Lead Retrieval. De no hacerlo así, se aplicará un cargo por reemplazo por cualquier complemento que falte.
f) Todos los escáneres móviles de Lead Retrieval de Fira de Barcelona se entregarán directamente en el stand del cliente (expositor) antes del evento en un plazo máximo de 2 semanas antes y mínimo de 120 minutos después de la inauguración oficial del evento (dependiendo de la situación, podrá prolongarse hasta un plazo máximo de 2 horas tras la inauguración del evento). Esto será aplicable a todos los pedidos realizados y pagados 48 horas antes de la inauguración del evento.
g) Los pedidos de escáneres móviles realizados in situ pueden necesitar hasta dos horas de procesado y están sujetos a disponibilidad. Se recomienda realizar los pedidos con un margen considerable antes de que comience el evento.
h) Todos los escáneres móviles se recogerán directamente en los stands el último día del evento. El cliente/expositor podrá concertar un horario para la recogida, pero estará sujeto a la disponibilidad del equipo de asistencia de Lead Retrieval. En un plazo máximo de 60 minutos después de la clausura oficial del evento, deberán recogerse todos los dispositivos.
5. Portal web
a) Para utilizar el portal web se requiere un ordenador y conexión a Internet. Lead Retrieval de Fira de Barcelona no será responsable de ninguna incidencia de pérdida de conectividad y sus consecuencias, ni de averías en los ordenadores, con la consiguiente pérdida, deterioro o corrupción de datos.
b) El usuario reconoce que se le ha informado y que se le ha facilitado toda la información necesaria para una correcta utilización del portal web.
c) Para entrar en el portal web se facilitará al usuario un nombre de usuario y una contraseña, que serán personales e intransferibles.
d) Únicamente el administrador estará autorizado a acceder al portal web. El administrador será el usuario que realizará el pedido de Lead Retrieval, a menos que se indique que otra persona actuará como administrador, indicando sus datos de contacto. Los usuarios del escáner no tendrán acceso al portal web.
e) Condiciones de uso del expositor
i) El arrendatario es responsable de abonar un cargo por reemplazo de 200 € por cualquier deterioro, robo o pérdida de un escáner móvil. Asimismo, es responsable de abonar un cargo por reemplazo de 25 € por cualquier complemento deteriorado, robado o perdido que figure en el apartado «IV.e)».
ii) En caso de que el arrendatario haya contratado la exención de responsabilidad por pérdida o daños de Lead Retrieval de Fira de Barcelona, esta anulará la responsabilidad del arrendatario de devolver el dispositivo y/o sus complementos o de devolverlos en buen estado.
iii) Las siguientes reglas se aplican a la exención de responsabilidad por pérdida o daños de Lead Retrieval de Fira de Barcelona:
1) La exención de responsabilidad por pérdida o daños de Lead Retrieval de Fira de Barcelona supone la anulación de la responsabilidad del arrendatario de devolver el dispositivo de alquiler y/o sus complementos o de devolverlos en buen estado.
2) El arrendatario debe comunicar de inmediato el daño, la pérdida o el robo al Servicio de Atención al Cliente de Lead Retrieval de Fira de Barcelona y/o a uno de sus representantes.
3) Para cualquier dispositivo robado o perdido, el arrendatario debe presentar una denuncia en la policía y después una copia de esta al Servicio de Atención al Cliente de Lead Retrieval de Fira de Barcelona o a su representante. Si no se presenta la copia en las 24 horas siguientes a la comunicación de la pérdida o robo del dispositivo, se anulará la exención de responsabilidad y el arrendatario será responsable de pagar el correspondiente cargo por reemplazo.
4) Los usuarios pueden contratar el seguro antes de la entrega del dispositivo alquilado. En consecuencia, una vez entregado el dispositivo no se podrá contratar el citado seguro.

General Conditions of Use for the Lead Retrieval Service
1.- General Conditions of Use and Acceptance
These General Conditions of Use expressly govern the relationship between the FIRA DE BARCELONA and the Users (trade visitors) and the Users (exhibitors) who acquire the Lead Retrieval Service offered by the FIRA DE BARCELONA for the Mobile World Congress 2023 (MWC) organized by GSMA Ltd., as well as the regulations and information for Users of this service.
The use of this service implies the User’s full and unreserved acceptance of the General Conditions of Use described in this document.
If you are using our Services on behalf of any entity, you represent and warrant that you are authorized to accept these terms on such entity’s behalf, and that such entity agrees to indemnify you and us for violations of these terms
FIRA DE BARCELONA may at any time modify these Conditions of Use by posting the changes in question online for their perusal by Users prior to the use of the service. You can access to this Terms&Conditions at https://leadretrieval.firabarcelona.com/en/mwc-terms-conditions/
2.- Lead Retrieval Service
The Lead Retrieval service rendered by FIRA DE BARCELONA allows users to capture and manage the information of the attendants to the Mobile World Congress 2023 (hereinafter “MWC”), containing different personal passes or QR devices. The said information consists of data provided during the registration process for the MWC. The following conditions apply to all users and the overall service, including, without limitation, the App and the Web Portal.
All devices will be smartphones running Android 5.0 or higher and with a 5″ screen or larger, with a 4G data plan provided by a carrier. Units are limited and subject to availability. The scanning license allows access to and use of Fira de Barcelona’s Lead Retrieval application. The user acknowledges that he/she has been informed and provided with all the information necessary for a correct use of the application.
This information shall be obtained by scan on the FIRA DE BARCELONA Lead Retrieval official App and it will be accessible upon installation of the application in mobile devices and the Back-Office web service.
The aforementioned process is a voluntary exchange of information to which both parties, the scanner, using the FIRA BARCELONA Lead Retrieval App, and the scanned, a registrant at the MWC, agree.
3.- Access to the Lead Retrieval contact management service
Users may access the Lead Retrieval Service in their capacity as an exhibitor or trade visitor at the MWC 2023 event organized by GSMA Ltd. If the User accesses the service as a trade visitor, he/she must have registered for the event in question, having previously provided his/her username and password. These identifying elements that enable the User to access the Lead Retrieval Service are personal and non-transferable.
4.- Lead Retrieval Use for the surveillance and control of Covid SARS-coV-2
On an exceptional basis the use of Lead Retrieval and the processing of data so obtained shall be mandatory as a means of surveillance and control of Covid SARS- coV-2, so exhibitors will be obliged to collect the data of the contacts in meetings, interviews lasting over 15 minutes and any such other activity deemed of risk.
Only in cases to which the legislation in force may from time to time apply, Fira de Barcelona and/or GSMA shall be obliged to provide the Health Authorities with the information regarding potentially positive contacts. If so required, the data to be provided shall only be: identification details consisting of name, surnames and email address.
5. Obligations of the User
The User is obliged to use the Lead Retrieval Service in a diligent, correct and lawful manner and undertakes to refrain from:
a) Using it for purposes or ends that are contrary to the law, morals, good manners or public order.
b) The User undertakes to provide full and accurate information when registering for and making use of the service, and to update these details to ensure that this information is complete and accurate at all times.
c) The user undertakes to provide correct and complete information when registering for the service and when using it, and to update his/her data to ensure that the information is correct and complete at all times.
The User’s failure to abide by the above obligations in relation to the use of the service shall entitle FIRA DE BARCELONA, at its discretion and without prior notice, to block the User’s access to the Lead Retrieval Service if it believes the User has breached the Conditions of Use. Any such breach of these Conditions of Use constitutes unlawful and unfair business practice which could be detrimental to FIRA DE BARCELONA and/or the other Users of the service, and therefore the User accepts that he/she shall be liable for the consequences of any such damage, granting full indemnity to FIRA DE BARCELONA and GSMA Ltd. as the event organizer, especially those obligation related to Personal Data Protection.
6.- Liability of FIRA DE BARCELONA
The User acknowledges and accepts that the use of this service is entirely his/her own responsibility, granting full indemnity to FIRA DE BARCELONA.
FIRA DE BARCELONA shall only be liable for any damage that the User may incur as a result of using the service when this damage is attributable to the wilful misconduct of FIRA DE BARCELONA.
Notwithstanding the above, FIRA DE BARCELONA hereby states that it has adopted all the necessary measures, within its capabilities and the state of technology, to ensure the correct operation of the service.
At any time, FIRA DE BARCELONA reserves the right to: (1) modify or suspend access to part or all of the service for duly justified reasons; (2) modify part or all of any policy or condition applicable to the service; and (3) interrupt the operation of part or all of the service whenever it becomes necessary to carry out maintenance, correct errors, or implement other changes.
FIRA DE BARCELONA cannot guarantee that the Lead Retrieval Service does not contain any errors, nor that its use will bring the User specific results of an economic or any other nature.
FIRA DE BARCELONA shall not be responsible under any circumstances for indirect, accidental or fortuitous damages, including loss of profits, even though it may have been aware of the possibility of such damages occurring.
FIRA DE BARCELONA does not guarantee the required connectivity for the information synchronization and usage of the products, services or devices. Fira Barcelona Lead Retrieval is not to be held responsible for any consequences of the lack of connectivity.
In case of experiencing any malfunction, damage or loss of the device, or any issues with the services or products, Fira Barcelona Lead Retrieval encourages to notify any FIRA BARCELONA Lead Retrieval Service Desk and/or representative in a timely manner.
FIRA BARCELONA is not to be held responsible for any unforeseen acts that lead to cancelling or postponing the event, such as, but not limited to, demonstration/protests, strikes of any kind, structural damages, loss or shortages of power or acts of god. If any of the unforeseen acts would to take place, FIRA BARCELONA´s obligations shall be terminated and FIRA BARCELONA shall be entitled to all perceived payments.

Unless otherwise expressly set forth in writing, our site, the site materials, the third party content, the user content, any hyperlinks, our services and any other services and/or content included on or otherwise made available to you through our site (collectively, “FIRA DE BARCELONA content/services”) are provided to you on an as is or as available basis without any representations or warranties or conditions of any kind. We do not warrant that any FIRA DE BARCELONA content/services are free of viruses or other harmful components. We make no representations or warranties with respect to the availability, reliability or security of any FIRA DE BARCELONA content/services. Unless otherwise expressly set forth in writing, we disclaim any and all other warranties and representations (express or implied, oral or written) with respect to all FIRA DE BARCELONA content/services whether alleged to arise by operation of law, by reason of custom or usage in the trade, by course of dealing or otherwise including: (i) any and all warranties of merchantability; (ii) any and all warranties of fitness or suitability for any purpose (whether or not we knew, have reason to know, have been advised, or are otherwise aware of any such purpose); and (iii) any and all warranties of non-infringement or condition of title.
8.- Cancellations
The User may deregister from the Lead Retrieval Service at any time, without entitlement to the return of any amounts paid up to that time, or to make any claim whatsoever. Please contact with the Lead retrieval team at [email protected]
9.- Personal Data Protection
Personal data Protection: In accordance with the (EU) 679/2016 General Data Protection Regulation (“RGPD”), the personal data processing of the signatories (name, surname, email), of commercial contacts of FIRA DE BARCELONA and of the agents holding POA to hire the Lead Retrieval services, insofar as they are linked to their principal when carrying out the online process necessary for the hiring of the services, in order to prepare and execute these Terms and Conditions and for the legitimate interest of the Parties hereto to be able to manage the contractual relationship. Such personal data will not be shared with third parties. However, they may be processed by third-party service providers with whom the Parties have a data processing agreement in accordance with the applicable regulations. The Parties hereto will keep such personal data for the entire contractual term and subsequently block them during the limitation period of the legal responsibilities that may arise from the execution thereof. Each Party shall duly inform their contact persons, whose details were communicated to the other Party for any of the above purposes, of all the information herein contained at the time of the first communication.
Likewise, the aforementioned persons are informed of the possibility of exercising their rights of access, rectification, cancellation and opposition, limitation and restriction of processing in such terms as established by the GDPR by contacting FIRA DE BARCELONA: [email protected]; and using the email provided for this purpose when contacting the exhibitor during the Lead Retrieval hiring process.
In the event that the Exhibitor has obtained the express consent of the visitor or, failing that, the Visitor directly provided their QR code to the Exhibitor for scanning so that they can obtain the minimum data to organise an activity during the show and / or generate leads by sending a first communication via email with information directly related to the activity, FIRA DE BARCELONA will be authorised to transfer any such minimum personal data and, therefore, Annex 1 of the Transfer of Personal Data will apply.
Likewise, in the event that FIRA DE BARCELONA processes visitors’ personal data on behalf of the Exhibitor in order to support the Exhibitor in the organisation of any such activities and/or in the generation of leads, Annex 2 regulating Processing Order shall apply.
10.- Applicable legislation
The relationships established between the User and FIRA DE BARCELONA shall be governed by the provisions of Spanish law concerning applicable legislation and competent jurisdiction. Nevertheless, in cases where the law envisages the possibility of the parties being entitled to another jurisdiction, FIRA DE BARCELONA and the User hereby expressly relinquish any other jurisdiction they may be entitled to and agree to submit to the Courts and Tribunals of the city of Barcelona.
In all cases, the regulations of Spanish Law shall apply.
Products and services
1.- Orders and Deadlines
a) All orders placed before the celebration of the event must be fully paid at least 7 business days prior to the event date.
b) Orders placed once the event has begun must be fully paid upon order.
c) All orders placed once the event has begun are subject to availability.
2.- Payment Terms and Cancellations
a) Orders with open balances 7 business days before the event starts will be cancelled. Orders can be re-processed for a 50€ fee if payment is received within 7 days till the event starts. In such cases the device configuration and/or delivery may be delayed.
b) The cancelled orders are subject to on site pricing if the re-order is handled on-site. In these cases the configuration and delivery of the order may be delayed and is subject to availability.
c) If the received payment differs from the published prices on the moment of the purchase, Fira Barcelona Lead Retrieval will adjust the payment amount to the price on the order form.
d) All order revisions places after the pre-event deadline are subject to a 50€ processing fee.
e) No refunds will be given after the pre-event deadline.
f) Any unused or not picked up devices, services or products are not refundable.
g) If you experience any malfunction of your product, device or service, escalate immediately your issue to the Fira Barcelona Lead Retrieval Service Desk. Failing to do so in a timely manner will result in no refunds or replacement devices to be given.
3.- On Site Services and Terms
a) Orders for devices, products or services placed on site may require up to 2 hours of processing times and are subjected to availability. Fira Barcelona Lead Retrieval encourages customers to order with a considerable margin before the event starts.
b) Any sort of modification or customization of Fira Barcelona Lead Retrieval products, devices or services are subject to technician availability and may be subjected to a processing fee.
c) Fira Barcelona Lead Retrieval clients hereby agree to comply with all the Terms of Usage the Event Management and Fira Barcelona Lead Retrieval. The violation of these terms by any client or party cannot be held against Fira Barcelona Lead Retrieval. The client agrees to hold Fira Barcelona Lead Retrieval harmless and have reserved the right to terminate the contracted services, without refund or any sort of compensation to the involved parties. In addition, Fira Barcelona Lead Retrieval holds the right not to deliver any sort of information (leads, surveys, etc.) in case of such a violation.
4.- Application
a) The user acknowledges having been informed and having recived all the necessary information for the proper use of the application and the mobile scanner.
b) The rental of the mobile scanner includes a mobile device to scan the passes, the Lead Retrieval application of Fira de Barcelona and a scanning license. All devices are delivered pre-configured and ready to use.
c) The mobile scanner rental also includes 4G internet access connectivity for the duration of the event, exclusively for the use of Fira de Barcelona Lead Retrieval.
d) FIRA DE BARCELONA will in no case be responsible for the service provided by the operator or its incorrect operation, nor can it guarantee the availability of 4G connectivity.
e) All devices will be delivered with a charger and USB cable or with a one-piece charger. It shall be the customer’s responsibility to check that all add-ons are included and to report the lack of any of the above mentioned add-ons to the Lead Retrieval service team. Failure to do so will result in a replacement charge for any missing add-ons.
f) All Fira de Barcelona Lead Retrieval mobile scanners will be delivered directly to the customer’s (exhibitor’s) stand prior to the event no later than 2 weeks before and no later than 120 minutes after the official opening of the event (depending on the situation, this may be extended to a maximum of 2 hours after the opening of the event). This applies to all orders placed and paid for 48 hours before the opening of the event.
g) Mobile scanner orders placed on-site may require up to two hours processing time and are subject to availability. It is recommended that orders be placed with considerable lead time prior to the start of the event.
h) All mobile scanners will be picked up directly from the booths on the last day of the event. The customer/exhibitor may arrange a pick-up time, but it will be subject to the availability of the Lead Retrieval support team. Within 60 minutes after the official close of the event, all devices must be picked up.
5.- Web Portal
a) To use the Web Portal a computer and Internet connection is required. Fira Barcelona Lead Retrieval is not to be held responsible for the incidences of connectivity loss and thereof consequences or the malfunction of the computer and consequent Data loss, damage or corruption.
b) The user agrees to have been informed and provided all the required information for the correct utilization of the Web Portal.
c) To enter the Web Portal, the user will be provided a username and password. The username and password are personal and cannot be transferred.
d) Only the administrator shall be authorized to access the web portal. The administrator will be the user who will place the Lead Retrieval order, unless it is indicated that another person will act as administrator, indicating their contact details. Scanner users will not have access to the web portal.
On Site Services and Terms
e) Exhibitor Terms of Usage
i) The renter is responsible for a 400€ replacement fee for any damaged, stolen or lost rented mobile device. The renter is responsible for a 40€ replacement fee for any damaged, stolen or lost complement listed in “IV.e.”.
ii) In case the renter has contracted the FIRA BARCELONA Lead Retrieval Loss or Damage Waiver, FIRA BARCELONA Lead Retrieval will waive the renter´s responsibility to return the device and/or its complements or to return it/them undamaged.
iii) The following rules apply to FIRA BARCELONA Lead Retrieval Loss or Damage Waiver:
1. FIRA BARCELONA Lead Retrieval Loss or Damage Waiver, waives the responsibility of the renter to return the rented device and/or its complements or to return them undamaged.
2. The renter must report the damage, loss or theft to a FIRA BARCELONA Lead Retrieval Service Desk and/or representative immediately.
3. For any stolen or lost device, the renter must file a police report and present a copy to a FIRA BARCELONA Lead Retrieval Service Desk and/or representative. Failing to present the copy within the next 24 hours of informing the loss or theft of the device, will void the waive of responsibility and the renter will be responsible to pay the corresponding replacement fee.
4. Users may purchase the insurance prior to delivery of the rented device. Consequently once delivered the device the User cannot contract the aforementioned insurance.
